Terms & Conditions — Straithmore Web Solutions

By subscribing to Straithmore Web Solutions, you agree to be bound by the following terms. Please read them carefully before subscribing.

Agreement

By subscribing to Straithmore Web Solutions ("we," "us," "our"), you ("the Client") agree to be bound by these Terms and Conditions. Please read them carefully before subscribing.

Services

Straithmore Web Solutions provides website creation, ongoing updates, and hosting as a subscription-based service. The specific scope of services, pricing, and monthly change request limits will be outlined in your subscription plan at the time of sign-up.

Monthly change requests are limited based on your plan tier. Unused change requests do not carry over to the following month. Requests beyond your monthly limit may be declined or subject to additional fees at our discretion.

Subscription, Billing & Cancellation

Subscriptions are billed on a recurring basis. If a payment is missed, the Client will have a 30-day grace period to resolve the outstanding balance before services are suspended.

Clients may cancel their subscription at any time. Upon cancellation or non-payment beyond the grace period, access to the website and all associated services will be terminated. Straithmore Web Solutions is not obligated to provide refunds for any unused portion of a billing period.

Ownership of Website & Content

All websites, designs, code, and materials created by Straithmore Web Solutions remain our sole intellectual property.

Upon termination of the subscription for any reason, the Client loses all access to the website and its associated content. No files, code, or design assets will be transferred to the Client.

Client-Submitted Content

Clients may submit photos and other materials ("Client Content") to be added to their website. By submitting Client Content, you confirm that:

  • You own the content or have full legal rights to use and publish it
  • The content does not infringe on any copyright, trademark, or other intellectual property rights
  • The content does not contain anything unlawful, defamatory, or offensive

Straithmore Web Solutions is not responsible for any legal issues, claims, or damages arising from Client Content. We reserve the right to refuse or remove any submitted content at our discretion without notice.

Acceptable Use

Straithmore Web Solutions will not provide services to businesses operating in the following industries:

  • Adult or sexually explicit content
  • Cannabis, controlled drugs, or related paraphernalia
  • Gambling or betting services
  • Any business engaging in illegal activities

We reserve the right to terminate services immediately and without refund if a Client is found to operate in any of the above categories, or if a Client's website is used for any unlawful purpose.

Uptime & Service Availability

Straithmore Web Solutions will make reasonable efforts to keep websites online and accessible. However, we do not guarantee any specific level of uptime or availability. We are not liable for losses or damages resulting from downtime, outages, or technical issues beyond our control.

Limitation of Liability

To the fullest extent permitted by law, Straithmore Web Solutions shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of our services, including but not limited to lost revenue, lost data, or business interruption.

Our total liability to any Client for any claim shall not exceed the total fees paid by that Client in the three (3) months preceding the claim.

Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of the service following notice constitutes acceptance of the updated terms.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Saskatchewan, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.

Straithmore Web Solutions ("we," "us," "our") is committed to protecting the privacy of our clients and the visitors of websites we host. This Privacy Policy explains what personal information we collect, how we use it, and your rights regarding that information.

This policy complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). If you are located outside of Canada, please be aware that your information may be processed in Canada and subject to Canadian law.

About our clients (businesses subscribing to our service):

  • Business name, contact name, and email address
  • Billing address and subscription details
  • Communications you send us (e.g. change requests, support messages)
  • Photos and materials you submit for use on your website

About visitors to websites we host:

  • Anonymous, aggregated analytics data such as page views, traffic sources, and general geographic region
  • We do not collect names, emails, or any personally identifiable information from website visitors
Payment card details are handled entirely by our third-party payment processor and are never seen or stored by us.

How We Use Your Information

We use the information we collect to:

  • Set up, manage, and maintain your subscription and website
  • Process billing and send transactional communications such as invoices and payment notices
  • Respond to your requests and support inquiries
  • Improve the quality of our services using anonymous analytics data
  • Comply with legal obligations

We do not use your information for marketing purposes, and we do not send promotional emails.

Sharing Your Information

We do not sell, rent, or trade your personal information. We may share information only with trusted third-party service providers who assist in operating our business, including:

  • Payment processors (such as Stripe or PayPal) to handle subscription billing securely
  • Hosting and infrastructure providers to deliver and maintain your website

These providers are permitted to use your information only as necessary to perform their services for us. Some providers may be located outside of Canada, meaning your data may be processed in other jurisdictions including the United States.

Client-Submitted Content

When you submit photos or other materials to be published on your website, you are responsible for ensuring those materials do not contain personal information about individuals without their consent. Straithmore Web Solutions is not responsible for any privacy issues arising from content submitted by clients.

Data Retention

We retain your personal information for as long as your subscription is active and for a reasonable period afterward as required for billing, legal, or dispute resolution purposes. Anonymous analytics data may be retained indefinitely as it cannot be linked to any individual.

Security

We take reasonable technical and organizational measures to protect your personal information from unauthorized access, loss, or misuse. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

Your Rights

Under PIPEDA, you have the right to:

  • Request access to the personal information we hold about you
  • Request that inaccurate information be corrected
  • Withdraw consent to certain uses of your information (which may affect your ability to use our services)
  • Ask questions about how your information is handled
